C422 Vellacott Bill

In 2009, MP Maurice Vellacott (Saskatoon -Wanuskewin) introduced a Divorce Act reform bill, C422  to Parliament which aimed to make equal parenting a rebuttable presumption in child custody cases in Canada. The bill is here.

This bill was last introduced in the 40th Parliament, 3rd Session, which ended in March 2011.

This bill was previously introduced in the 40th Parliament, 2nd Session. The bill died on the order paper at the 2011 election call.

MP Vellacott, or other MPs or Senators are planning to introduce an equal parenting reform bill into the current session of Parliament. When such a bill will be presented depends on the position on the order paper.

We expect such a bill to be opposed by a wide array of special interests, especially those financial profiting from the current gendered, adversarial system.

To get ready for the battle for children’s rights to both parents at the federal level, parents and supporters need to review the arguments of the other side, and develop counter arguments.

A position paper by a lawyer working for the Parliamentary Library research bureau is available here. It seems primarily ideological arguments against the ideas of the bill, rather than legal arguments.

A position paper by the Canadian Bar Association is available here.
